Holicare is in no way an emergency service. In case of an emergency, you must call 15.

The general terms and conditions of use described below (the "GCU") detail the conditions of access and the terms of use of the services offered to users on and from the website www.holicare.com (the "Website") operated by the company HOLICARE SAS, a simplified joint-stock company with a capital of €290,748.30, whose registered office is located at 9, rue d'Alsace Lorraine – 92160 Antony, France, registered with the Nanterre Trade and Companies Register under number 893 088 377, intra-community VAT number FR13893088377 (hereinafter "Holicare").

Holicare commercializes an innovative solution designed to support mental health and well-being, based on a digital self-assessment questionnaire called "Holitest" and digital prevention and multidisciplinary teleconsultation care pathways (the "Solution").

The Solution is commercialized in France to companies, insurance companies, and mutuals which subscribe to a contract allowing the deployment of the Solution for the benefit of their employees or policyholders (the "Employee Users" and "Policyholder Users"). In this case, all costs related to the use of the Solution by the Employee User or Policyholder User are covered by the company, the insurance company, or the mutual so that the Employee User or Policyholder User has no costs to bear, provided the Solution is used within the limits set out in the contract concluded between Holicare and the company, insurance company, or mutual. Furthermore, the Solution can also be used by any other user who wishes to benefit from it on their own behalf ("Other User(s)") directly via the Website. In the latter case, the costs of using the Solution will be fully borne by the Other User, who agrees to pay them under the conditions detailed below.

The Solution includes for Employee Users, Policyholder Users, and Other Users (hereinafter collectively referred to as "User(s)" or "You"):

For Employee Users, Policyholder Users, and solely for Other Users who wish to register personally by paying the requested price, the Solution may also include (at the choice of the employer company, the insurance company, the mutual, or the Other User) access to either:

Users are invited to carefully read the GCU in their entirety before using the Solution and the Services.

1. Scope and Modifications of the GCU

1.1 Scope of the GCU
Any use of the Solution and Services implies the User's unreserved acceptance of these GCU. These GCU apply in their entirety to all Users. The User acknowledges that their consent is materialized by checking the box indicating that they accept the GCU.

1.2 Modification of the GCU
Holicare reserves the right to adapt and/or modify the GCU at any time, in whole or in part. Users will be informed of the modification of the GCU by email ten (10) days before they come into effect. After this period, each User will be invited to accept the new GCU upon their next login to their personal account. By exception to the above, all mandatory modifications (e.g., for regulatory or legal reasons) and/or minor modifications to the GCU—meaning any modifications that do not result in a significant change to the User's rights and obligations—will be made without notice and will be immediately applicable after Holicare sends the notification to the Users. Holicare reserves the right to restrict or prohibit access to the Solution for any User who has not accepted the modified GCU.

2. Access to the Solution

The Solution offered by Holicare is intended only for individuals at least 18 years of age. Each account is personal and can only be used by the User as a registered member. It cannot be used by a third party, nor transferred to a third party.

Users can browse the Website freely, but access to the Solution and Services is conditional upon opening a user account. To open this account, the User must provide the information requested in the online form (notably last name, first name, email address, phone number). Any user account is considered active and usable once (i) you have duly completed and validated the registration form, (ii) you have accepted these GCU and the privacy policy, and (iii) consented to the processing of your personal health data.

Once the account is created, the User can access it via the Website as many times as they wish, provided they enter the identifier and password mentioned during registration, which they can modify at any time. The User remains solely responsible for the choice of identifier and password chosen, particularly regarding their level of security. Under no circumstances can Holicare be held liable for the fraudulent use of the User's identifier and/or password. It is up to the User to take all precautions to keep their identifier and password secret. In the event of loss or theft of the User's identifier and/or password, the User is responsible for any resulting harmful consequences. Any use of the Solution and Services made via the User's identifier and password will be deemed to have been made by the User. If you become aware of or suspect that a third party has gained access to your account information, such as a password or identifier, You must inform Holicare as soon as possible by sending an email to contact@holicare.fr.

By opening an account on the Holicare platform, You accept and confirm that the provided information may be used by Holicare to send information via email. Information sent by email will notably allow Holicare to inform you of available content, new features, special events, etc. (non-exhaustive list). As the account holder, You can deactivate these emails at any time by changing your settings in the platform. This request will be processed without delay.

Each User remains free to delete their account at any time by notifying their wish by mail or email to the following address: contact@holicare.fr. Account closure requests are processed within eight (8) days, but the request to close the account immediately makes access to the Services unavailable.

Holicare may deactivate your user account at any time, and with immediate effect, in the event You fail to comply with these GCU.

3. Availability of the Solution

Although Holicare makes its best efforts to ensure the availability of access to the Website and a good quality of access to its Solution, the company cannot be held responsible for an interruption of this access due to updates, maintenance, server unavailability, or an alteration in quality, regardless of the reason and duration. You declare that you know and accept the characteristics and limits of transmitting information via the Internet, as well as the costs associated with connecting to this network.

In particular, it is the Users' responsibility to ensure that the technical characteristics of the hardware and software they use allow access to the Solution in good conditions, and to take all appropriate measures to protect themselves against contamination by potential malicious programs.

Consequently, Holicare's liability cannot be engaged, either expressly or tacitly, for any damage whatsoever suffered by You or a third party.

Holicare also strives to enable the execution of the Services on business days from 9:00 AM to 8:00 PM.

4. Services ("Services")

4.1 Opening an account gives all Users free access to a "Holicare self-assessment questionnaire". The purpose of this questionnaire is to provide you with an evaluation of your mental health state as you perceive it:

The "Holicare assessment questionnaire" is not intended to provide a medical diagnosis but can direct you toward a health professional. Holicare has a network of health professionals. The "Holicare self-assessment questionnaire" helps evaluate the intensity of possible professional burnout (or "Burn Out") using questionnaires documented in medical literature. The Holicare process has been evaluated to verify the consistency of results and clinical exams. Said questionnaire presents a series of closed questions which you should answer spontaneously, according to your current situation, avoiding neutral answers. To establish a link with the Holicare teams, You must provide your last name, first name, and personal email address. The questionnaire is organized into chapters that correspond to the evaluation of your mental health state across several dimensions. The result of the questionnaire is consultable only by Holicare health professionals and Holicare partner health professionals who will follow up with You. The results are accessible in your user account. You can transmit them to your attending physician and your occupational physician. It is understood that the results may also be sent to your attending physician and occupational physician, with your consent.

4.2 The information provided in the questionnaire is automatically processed by Holicare and allows Holicare to define a personalized pathway. Holicare offers three types of pathways based on the questionnaire results: a preventive pathway (or preventive education) and a care pathway validated by a Holicare psychologist, or an analysis and orientation pathway.

4.2.1 Preventive Education Program The Holicare preventive pathway is freely accessible to all Users and provides access to content that improves the User's mental health state on various dimensions detected during the self-assessment by the questionnaire. At the end of the pathway, You have the opportunity to validate your acquired knowledge up to obtaining a certification. The content remains accessible in case of need until your account is closed. At any time, the possibility of a new self-assessment allows you to measure your mental health state.

4.2.2. Care Pathway The Holicare care pathway allows for personalized care by Holicare's partner health professionals. An expert multidisciplinary team is deployed to surround You, validate the clinical assessment, and define the most suitable care pathway. Within the framework of the Care Pathway, appointments with health professionals are offered to You.

The Holicare care pathway is accessible to Employee Users and Policyholder Users, within the limit and following the conditions provided in the contract concluded between Holicare and the employer and/or the insurance company or mutual of the Employee User and Policyholder User. Under these conditions, the costs of the care pathway are covered by the employer, insurance company, or mutual on behalf of the Employee User or Policyholder User concerned. You have the option to cancel or reschedule an appointment to another date no later than 12 hours before the time of the selected appointment. Any appointment canceled or rescheduled less than 12 hours beforehand will be deducted.

4.2.3. Orientation Pathway The analysis and orientation pathway allows You to benefit from two appointments with the coordinating nurse and one appointment with a psychologist to enable You to analyze the Holitest results together, confirm the profile of your mental state with a psychologist, and then be directed toward appropriate types of care.

5. Holicare's Liability

The obligations incumbent upon Holicare are obligations of means. The User is informed that the Holicare assessment questionnaire, "Holitest", is not intended to provide a medical diagnosis. The Holitest helps evaluate the intensity of possible professional burnout (or "Burn Out") using questionnaires documented in medical literature. The Holicare process has been evaluated to verify the consistency of the results and the clinical exam. That said, the questionnaire presents a series of closed questions to which the User must answer spontaneously, according to their situation at the present time. Insofar as the results depend on the state the User was in on the day they answered the questions, their sincerity, and their involvement, the Holitest can under no circumstances be considered an exact science that determines, with certainty, the User's profile. Holicare can under no circumstances be held responsible for the conclusions drawn for each User following their evaluation by the Holitest. Each of Holicare's partner professionals exercises their activity completely independently and within the strict framework of the legal, regulatory, and ethical obligations applicable to their activity. Within the framework of the execution of the Services, Holicare is responsible for connecting the User with the partner professional(s) identified by the coordinating nurse who will have reviewed the Holitest results. Holicare can in no way guarantee an improvement in the Users' condition over the course of the Services' execution. Holicare's liability cannot be engaged in the event a User's condition worsens.

6. General Provisions

As part of the evolution of the Services, certain features may be modified or removed. Holicare commits to informing You so that You can give your consent to the use of your data within the framework of these new Services. Service evolutions that have consequences on the processing of your data will be notified to you, and a request to renew your consent for the processing of your data will be necessary. Holicare reserves the right to implement certain features of the Services progressively.

6.1 Intellectual Property Rights

The Services, databases, data, and information used, presented, or made accessible via the aforementioned questionnaire, the preventive education programs, the trademark and logo, as well as the IT design and content of the Services, including text, graphics, images, and sounds composing them, without limitation, constitute the exclusive property of Holicare. Holicare grants You a non-assignable, non-transferable, non-exclusive right to access and use the Services. You are strictly prohibited from directly, indirectly, or through a third party, arranging, altering, correcting, translating, or modifying the Website and the Services. Any reproduction, imitation, representation, or distribution of all or part of this content on any medium is strictly prohibited. Requests relating to intellectual property rights can be sent to Holicare by email to the following address: contact@holicare.fr. Failure to comply with these provisions constitutes an act of infringement engaging the civil and criminal liability of the offender. More broadly, You guarantee that the content provided to Holicare does not violate any intellectual property right held by a third party. You are solely responsible for the content, images, or other materials you transmit to Holicare, and by extension, to other Holicare users, within the framework of using the Services. Under no circumstances can Holicare be held liable if the transmitted content violates copyrights or trademarks held by third parties or harms a third party in any way whatsoever. You agree not to use the Services provided by Holicare for purposes contrary to public order or morality, or infringing on the rights of third parties. In any case, You agree to indemnify Holicare against all financial consequences related to a legal action or a claim originating from third parties related to your use of the Services. Holicare reserves the right to remove access to the Services, without delay or warning, in the event of your failure to comply with these GCU. In this case, your account will be deleted along with its inherent data. In this case, Holicare will inform you without prejudice to any additional claims for damages.

6.2 Information Provided by the User

You certify the accuracy of the information necessary for the execution of the Services described above. You are solely responsible for any error or omission. You are prohibited from using false information or using third-party information without authorization.
